What Rights Do You Have for Flight Issues?

Flight compensation
For a flight delay of three hours or more (delayed arrival at the destination airport), the airline must compensate the affected passengers, unless extraordinary circumstances apply. According to the EU regulation, the individual passenger's claim is divided into four different levels:
250€
all flights up to 1,500 km
400€
all intra-Community flights over 1,500 km
400€
all other flights between 1,500 km and less than 3,500 km
600€
all flights over 3500 km that are not intra-community

If the airline has offered passengers alternative transportation to their final destination and this takes between 2 and 4 hours, depending on the distance, to arrive at the destination airport, the airline may reduce the compensation by 50%.

Ticket refund
Depending on who caused the flight cancellation, different reimbursement claims arise.
1. You canceled yourself / no-show
If you canceled your flight yourself or did not show up at the airport (a so-called no-show), you are entitled to at least a refund of the taxes and airport fees paid. This can sometimes be up to 70% of the ticket price. You are also entitled to a refund of the base fare if the airline was able to resell your seat. In this case, the airline will refund up to 95% of the total ticket price.
Lawyer’s tip: Even if you have purchased a non-refundable low-cost ticket, you are entitled to a refund of taxes, fees and any surcharges.
2. Your flight is delayed by more than 5 hours
You are entitled to a full ticket refund if your flight is delayed by more than five hours and you no longer wish to board the flight. Such a long delay is essentially equivalent to a flight cancellation and is treated legally as such.
3. Your flight has been cancelled
If the airline cancels or postpones your flight less than 14 days before departure and the replacement flight offered to you is not available, you are entitled to a ticket refund. You can find more detailed information under Flight Cancellation.
4. You were denied boarding

If you have opted for a ticket refund, the airline is obliged to refund the ticket price within 7 days.

Damages
The following claims for damages may arise due to a flight disruption:
- Compensation for meals, accommodation , or alternative transportation: If the airline fails to provide the care it is obligated to provide, you can still use these services at your own expense. Be sure to keep all receipts, as you can reclaim any payments you made for care services from the airline as part of your compensation claim. These amounts cannot be offset against your compensation.
- Reimbursement of legal fees: Since airlines often refuse to pay compensation, these cases can end up in legal disputes and even go to court. If the airline loses the case and has to pay compensation, you can also claim your legal fees as damages and reclaim them from the airline. We always settle these costs directly with the airline, so there's no additional expense for you as a client.
- Compensation for a missed appointment: Enforcing this claim is considered particularly complex, so I recommend consulting a lawyer. This compensation claim can also be offset against the compensation payments.
- Claims against tour operators: In addition to the compensation payment from the airline, you may be entitled to a reduction in the travel price from the tour operator.

Hotel and travel costs
In the event of flight rescheduling, delays, or cancellations, you may have to travel to the airport again and require an additional overnight stay before your outbound or return flight. This may incur additional costs for buses, trains, taxis, or hotels/accommodations. The airline is responsible for reimbursing these costs.
Lawyer’s tip: Make sure your costs are reasonable; the airline will not reimburse you for 5-star accommodations unless you can prove that this was your only alternative.
This happened to me personally once in Frankfurt. Lufthansa had to reimburse an overnight stay for €800 because of a trade fair taking place at the same time, which they did without any problems.
Therefore, keep your receipts safe. It's best to take a photo of each receipt with your smartphone. You can then submit these receipts to the airline.

Travel price reduction
If you booked your trip as a package, meaning hotel, flight, and possibly a rental car as a so-called package tour , you may be entitled to a reduction in the travel price. If your flight arrives more than three hours late, or is canceled or postponed, you should contact your tour operator immediately to protect your rights. In addition to flight compensation, you are also entitled to a reduction in the travel price, with the claims being offset against each other.
For cheaper hotels, it is often worthwhile to simply claim flight compensation of €250, €400, or €600.

What do your claims look like in practice? Using examples of flight delays, cancellations, or lost luggage, we’ll show you what compensation and services you can claim.
Example 1
The Müller family (2 adults, 2 children) from M. uses their savings to treat themselves to a flight to Chicago.
Upon arrival at Stuttgart Airport, the family discovers that due to a lack of staff, their flight will depart at 6:30 p.m. instead of 9:00 a.m.
Attorney Braun:
The Müller family is entitled to compensation under EU Regulation 261/2004. Since the flight is delayed by more than three hours and will cover a distance of more than 3,500 km, each family member is entitled to €600 = €2,400.
The family, consisting of four people, is entitled first to assistance from the airline. This includes free meals and refreshments for waits of more than five hours, two free faxes, and free telecommunications. They can request alternative transportation from the airline or cancel the contract.
If the 6:00 PM flight is canceled and is rescheduled for the next day, for example, the airline must also cover the transportation costs to and from a hotel (taxi and/or train fares) and reimburse the hotel costs. Of course, Ms. Müller kept all receipts.
Since the Müller family has retained a lawyer, they will receive the full reimbursement amount from their legal counsel.
Example 2
The Fischer family from S (father, mother, and 13-year-old daughter) wanted to fly back to Stuttgart after their vacation in Palma de Mallorca.
Their return flight was booked for 11:00 a.m. At the counter, the family learned that their return flight with Eurowings had been canceled and a return flight with Avion had been booked for 7:40 p.m. instead. Unfortunately, this flight was also canceled shortly before departure. In both cases, the airlines were at fault due to strikes by their employees.
However, the lady at the service desk offers a replacement: the family can either fly with Eurowings to Nuremberg that same evening (approximately 210 km by car from Stuttgart) or book a flight the next morning. The Fischer family opts for the late evening flight and has a friend pick them up at the airport in Nuremberg.
Attorney Braun:
The two cancellations each result in claims totaling €250 per person. For journeys from Nuremberg to Stuttgart, there are additional travel expenses, which add up to an additional €0.3 per km, or €126.
This isn’t an uncommon case for me. The Fischer family has a number of claims that they can enforce against both Eurowings and Avion. In addition, the family is entitled to meals while waiting and free Wi-Fi to enable communication. The family therefore has a total claim against the airlines totaling €1,626 (250*3 + 250*3 + €126).
If the family had chosen to fly the next day, they would also have been entitled to reimbursement of hotel costs and transportation to and from the airport.
Because the family has hired a lawyer, they will receive the full amount of the refund and won’t have to shell out up to €846 to debt collection agencies like Flightright, Airhelp, or Compensation2Go.

Buchungscode
Auch Buchungsnummer, Reservierungsnummer, Booking Code oder Airline Auftragsnummer genannt– besteht generell aus einer Kombination aus 6 Zahlen und Buchstaben, z.B. LHGCH4, wobei die Buchstaben immer groß geschrieben werden.
Wo finde ich meinen Buchungscode?
Den Buchungscode finden Sie meistens in der Bestätigung Ihrer Flugbuchung oder Buchungsbestätigung des Reisebüros. Nicht zu verwechseln mit der Ticketnummer!
Er besteht aus 6 Zahlen und Buchstaben, z.B. ZKLCI7, wobei die Buchstaben immer in BLOCKBUCHSTABEN geschrieben sind.
Bei online Buchungen erhält man den Buchungscode meist direkt nach Abschluss der Buchung auf der Webseite. Sonst findet man den Buchungscode immer in der Buchungsbestätigung, auf dem E-Ticket und auf der Rechnung (auch „Passenger Receipt“ genannt).
Code-Sharing
Wenn ein Flug nicht von der Airline, bei der der Flug gebucht wurde, sondern von einer anderen Airline durchgeführt wird.
Beispiel: Sie buchen Ihren Flug bei Lufthansa und diese lässt den Flug von Eurowings durchführen.
Pauschalreise
Eine Pauschalreise ist eine Reise bei der mindestens zwei Arten von Reiseleistungen zusammen gebucht werden. Dies können beispielsweise ein Paket aus Flug, Hotel und Mietwagen sein. In diesen Fällen ist für alle Fragen und Ansprüche der Reiseveranstalter verantwortlich.
